HC STAYS SEZ APPOINTMENT

A two-judge bench of the High Court comprising chief justice a R Dave and Justice Ramesh Ranganathan on Monday stayed the appointment of P Venugopal as development commissioner of the special economic zones.

The bench made the order while hearing a public interest writ petition seeking a writ of quo-warranto against the appointment on various grounds including that the incumbent must be of the rank of deputy secretary.

The government had appointed Venugopal, director, Software Technologies Park of India, as development commissioner. A similar writ petition was filed consequent to an earlier notification appointing Manoj Kumar to the office, which was also stayed.

The writ petitioner, Ahmed Ethesham contended that the law did not permit the director of the STPI to be automatically appointed as development commissioner. The director may not possess the required technical qualifications to oversee the 48 odd centres established with the tax-free assurances and other benefits at the SEZs.
